1. Acceptance of Terms

By adding On Record ("the Bot") to your Discord server or using any of its features, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Bot.

2. Description of Service

On Record is a Discord bot that allows users to create and track predictions about music artists. The Bot provides the following features:

• Creating predictions about artist milestones and achievements
• Tracking prediction status (pending, correct, incorrect)
• Viewing personal prediction history and statistics
• Displaying accuracy metrics and leaderboards
• Admin tools for resolving predictions

3. User Responsibilities

When using the Bot, you agree to:

• Provide accurate information in your predictions
• Not use the Bot to harass, abuse, or harm others
• Not create predictions that contain illegal content, hate speech, or threats
• Not spam or abuse the Bot's features
• Respect Discord's Terms of Service and Community Guidelines
• Not attempt to exploit, hack, or reverse engineer the Bot
• Not impersonate others or create false predictions on their behalf

4. Acceptable Use

You may not use the Bot to:

• Post or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Violate any local, state, national, or international law
• Infringe on intellectual property rights of others
• Collect or store personal data about other users without their consent
• Interfere with or disrupt the Bot's functionality or servers
• Attempt to gain unauthorized access to any portion of the Bot or related systems

5. Content and Predictions

You are solely responsible for the content of your predictions. By creating a prediction:

• You grant us the right to store, display, and share your prediction within Discord servers where the Bot is installed
• You represent that your prediction does not violate these Terms or any applicable laws
• You understand that predictions are visible to other users in the Discord servers where they are created
• You acknowledge that predictions cannot be edited once submitted, though they may be deleted upon request

6. Admin Features and Responsibilities

Server administrators and authorized users with admin access:

• May resolve predictions as correct or incorrect
• Must exercise good faith when resolving predictions
• Should not abuse admin privileges to unfairly resolve predictions
• Are responsible for maintaining fair and accurate prediction resolution in their servers

7. Availability and Modifications

We strive to maintain the Bot's availability but make no guarantees:

• The Bot may be temporarily unavailable due to maintenance, updates, or technical issues
• We reserve the right to modify, suspend, or discontinue the Bot at any time without notice
• We may update features, commands, or functionality as needed
• We are not liable for any downtime or loss of data

8. Privacy and Data

Your use of the Bot is also governed by our Privacy Policy. By using the Bot, you consent to our collection and use of data as described in the Privacy Policy. Please review our Privacy Policy to understand how we handle your information.

9. Intellectual Property

The Bot, including its code, design, features, and branding, is owned by us and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the Bot's code or features
• Use the Bot's name, logo, or branding without permission
• Create derivative works based on the Bot

10. Disclaimers and Limitation of Liability

THE BOT IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding accuracy, reliability, or completeness of predictions
• Warranties of uninterrupted or error-free service

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify and hold harmless the Bot operators, developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Bot
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Content you submit through the Bot

12. Termination

We reserve the right to:

• Terminate or suspend your access to the Bot at any time for any reason
• Remove the Bot from servers that violate these Terms
• Delete predictions that violate these Terms or applicable laws
• Ban users who repeatedly violate these Terms

You may stop using the Bot at any time by removing it from your Discord server or ceasing to use its commands.

13. Dispute Resolution

If you have any disputes regarding the Bot, please contact us first to attempt to resolve the issue informally. Any unresolved disputes will be governed by the laws of your jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by:

• Updating the "Last Updated" date at the top of this document
• Posting a notice in our Discord server or on our website

Your continued use of the Bot after changes are posted constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and On Record regarding the use of the Bot.
